Defective Loan Agreements
Can
we help you?
If you have taken out a loan or a mortgage you could have been overcharged, or your the agreement could be unenforceable. Dispute Solicitors are specialist solicitors dealing with financial or insurance disputes. Our knowledge ensures that we can advise you quickly whether you have been overcharged on your loan or mortgage and make the claim for you to recover the compensation that is rightfully yours.
How Do You Know If You Can Make A Claim?
There are several different ways you might have been mis-sold a loan or mortgage.
Regulated Loans Under £25,000
There are strict rules to comply with when completing a loan document for under £25,000. If the loan documentation is not correctly completed in line with the Consumer Credit Act it may be unenforceable by the bank or other lender. If we can prove this, you will be entitled to a full refund of your loan, and any goods you purchased with the money (such as a car or home improvements) will still be yours to keep!
Calculation Of Loan Payments
You might also be able to make a claim if the way the lender has charged interest, penalty fines or the way they have calculated the redemption figure is incorrect. Once again, Dispute Solicitors will be able to review your documentation and tell you if this has happened to you. If it has, you will be entitled to compensation or if the loan is sufficiently defective, to a full refund of all payments made.
Loans Acquired Through A Third Party (Brokers)
If you obtained your loan or mortgage through a broker and they failed to disclose commissions payable to them under the terms of the referral, once again this can make the entire loan unenforceable which would allow you a full refund of payments and to keep any asset purchased with the loan or mortgage. At the least you will be entitled to compensation to the amount of commissions paid and there may also be further adjustments to future payments (i.e. a reduction).
Was Your Home Repossessed?
If you have had your home repossessed but we can prove that one or all of the factors above was involved, recalculations to the mortgage could show that had the correct fees been charged, or the commission not paid to the broker, you would not have been in arrears at the time of repossession. If this is the case you will be entitled to compensation.
